This Privacy Policy (the “Privacy Policy”) is designed to inform you of how Regen Search uses your personal data (the “Personal Data” or “Data”). It also explains your rights and how to exercise them.

2. Who is Regen Search? 

The website accessible at www.regen-search.com (the “Website”) is published by Regen Search (“Regen Search” or the “Company”). Information relating to the Company is available under the “Legal Notice” section.

In all of its activities, including when you browse the Website and when Regen Search identifies and approaches candidates through professional networks such as LinkedIn as part of its executive search practice, Regen Search acts as the data controller within the meaning of applicable personal data protection regulations, namely Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data (GDPR), and the French Data Protection Act No. 78-17 of 6 January 1978 as amended (« Loi Informatique et Libertés »).

This means that Regen Search determines the purposes and means of the processing of Data.

In this respect, Regen Search undertakes to respect your rights when processing your Data and, more generally, to implement all necessary measures to protect your privacy in accordance with personal data protection regulations.

 

3. What is Personal Data and what is processing of Personal Data?

Personal Data is any information that enables you to be identified, directly or indirectly, such as your name, surname, email address, postal address, telephone number, and more generally any information relating to you.

Your IP address and browsing data on the Website are also Personal Data that enable you to be indirectly identified.

Any operation carried out on Personal Data, such as collection, recording, or storage on servers, constitutes processing of Personal Data. Regen Search must therefore comply with personal data protection regulations when processing such Data.

 

4. What Personal Data is processed by Regen Search?

Regen Search collects the following Personal Data:

  • Identification and contact data (name, surname, email address, telephone number, photograph, etc.)
  • Data relating to education and professional background (curriculum vitae, educational background, professional experience, areas of functional expertise, languages spoken, tools and systems mastered, professional interests and motivations, LinkedIn profile URL)
  • Browsing data on the Website (collected via cookies)
  • Any information that you wish to provide in the context of your application

Regen Search does not wish candidates to provide sensitive data and any information relating to their origin, health status, personal life, sexual orientation, political opinions, trade union activities, religious beliefs, or membership or non-membership of an ethnic group, nation or race.

 

5. How do we collect your Data?

Data is collected through one of the following two channels:

  • either because it has been provided directly, in particular via the contact form on the Website;
  • or because it has been obtained indirectly through professional networks, in particular LinkedIn, as part of a proactive executive search approach.

Where Data has been collected indirectly in this manner, data subjects benefit from the same rights in relation to their Personal Data as any other individual, as set out in Article 12 of this Policy.

 

6. For what purposes is your Data collected?

Personal Data is collected and processed for the following purposes:

  • To identify and approach relevant leadership profiles in order to assess their potential fit for active mandates: this processing is based on Regen Search’s legitimate interest in conducting proactive executive search on behalf of its clients;
  • To evaluate a candidate’s suitability in relation to a specific mandate and assess their professional experience, functional expertise and leadership profile: this processing is based on Regen Search’s legitimate interest;
  • To maintain profiles in Regen Search’s candidate database for the purpose of matching profiles to current and future mandates: this processing is based on Regen Search’s legitimate interest in building and maintaining a confidential talent database. Access to this database is strictly limited to Regen Search. Data subjects may object to this processing at any time by writing to the address indicated in the section “What is the contact point to exercise your rights?”;
  • To keep candidates informed of leadership opportunities that may be relevant to their profile and career trajectory: this processing is based on Regen Search’s legitimate interest in maintaining active and meaningful engagement with its candidate network;
  • To develop market intelligence on leadership talent across the food value chain, including sourcing, procurement, supply chain, sustainability and commercial functions: this processing is based on Regen Search’s legitimate interest in delivering informed and precise search execution;
  • To produce aggregated and anonymised statistics on candidate profiles (by geography, function, seniority or sector, for example) for internal improvement purposes and, where applicable, for the production of market intelligence reports shared with clients or prospects. Regen Search does not carry out profiling and does not make automated decisions on the basis of this information. This processing is based on Regen Search’s legitimate interest in improving its processes, delivering informed search execution, and developing its market expertise;
  • In the event of disputes or for the management of the exercise of rights: this processing is based on Regen Search’s legitimate interest in defending its interests in the event of a dispute, providing data subjects with information relating to the processing of their Data where necessary, and handling their requests;
  • Where the data subject is a client: Data is processed to deliver executive search mandates and manage the contractual relationship. This processing is based on the performance of the contract;
  • Where the data subject is a prospect: Data is processed to develop and promote Regen Search’s practice. This processing is based on Regen Search’s legitimate interest.

 

7. How long is Personal Data retained?

‍We retain your Personal Data only for as long as necessary to fulfil the purposes for which it was collected, or to comply with our legal obligations, including in relation to accounting, tax and audit requirements.

In the context of our executive search activities, your Data is retained for a maximum period of two (2) years from your last contact with us (a conversation, email exchange, or update to your profile), unless you have objected to this.

Beyond this period, we may reach out to ask whether you wish your Data to be retained for longer. In the absence of a positive response, your Data will be deleted.

If you object to your Personal Data being retained in Regen Search’s candidate database, or if your profile has not been taken forward in connection with a specific mandate, we retain your Data for up to three months following the conclusion of that process, after which it will be deleted.

If you are a client: your Data is retained for the entire duration of the contractual relationship and then for 5 years for evidentiary purposes.

If you are a prospect: your Data is retained for 3 years from the last contact from you.

For certain processing activities identified above, the Company will retain your Data for a different duration:

  • Personal Data collected via cookies may be retained for a maximum period of 25 months
  • In the event of a dispute, Personal Data is retained until the resolution of the dispute / the signing of a settlement agreement / the expiry of the applicable limitation periods

 

8. Who may have access to your Personal Data?

The Personal Data collected by Regen Search in the course of its executive search activities may be disclosed to the following recipients:

  • Our clients, where your profile has been assessed as potentially relevant to a specific mandate and where you have been informed of and have consented to your profile being presented. You may withdraw your consent at any time. Your profile will never be shared with your current employer.
  • Our processors and partners, including for hosting, data management, and the operation of tools used in the search process. We may also rely on third-party providers using artificial intelligence for specific purposes, such as assisting with the organisation or analysis of candidate information. These third parties are granted access to your Personal Data only to the extent necessary to perform these tasks on our behalf and are contractually bound not to disclose or use it for any other purpose.
  • Competent authorities or third parties, where disclosure is required by applicable law, regulation or court order, or where such disclosure is necessary for the purposes of an investigation, injunction or legal proceedings, whether in France or abroad.
  • Potential acquirers and their advisors, in the event of a transfer of business, transfer of assets of Regen Search or acquisition by a third party. In such circumstances, Regen Search ensures that such recipients are subject to appropriate confidentiality obligations.
  • Administrative or judicial authorities, as well as Regen Search’s legal advisors, where necessary to comply with a legal obligation, to assert or defend its rights in the context of a dispute, or to protect the rights, property or safety of Regen Search.

 

9. Is Data transferred outside the European Union?

As part of the tools we use (see section “Who may have access to your Personal Data?”), your Data may be transferred outside the European Union. The transfer of your Data in this context is secured by the following means:

  • either the Data is transferred to a country that has been subject to an adequacy decision by the European Commission in accordance with Article 45 of the GDPR: in this case, this country ensures a level of protection considered sufficient and adequate under the GDPR;
  • or the Data is transferred to a country whose level of data protection has not been recognized as adequate under the GDPR: in this case, these transfers are based on appropriate safeguards referred to in Article 46 of the GDPR, adapted to each provider, including, without limitation, the conclusion of standard contractual clauses approved by the European Commission, the application of binding corporate rules or reliance on an approved certification mechanism;
  • or the Data is transferred on the basis of one of the appropriate safeguards described in Chapter V of the GDPR.

10. How does Regen Search protect your Personal Data?

Regen Search implements all useful and reasonable precautions with regard to Personal Data and the risks arising from their processing, in order to preserve their security and, in particular, to prevent them from being altered, damaged, or accessed by unauthorized third parties. As the transmission of Personal Data via the internet is not completely secure, Regen Search cannot guarantee the complete security of the Personal Data it processes.

 

11. What cookies are used and how can they be configured?

General information

Cookies are small amounts of information stored in files within the browser of a computer, smartphone or other device. They are generated during any navigation on a website. Cookies are accessible and stored by the websites visited and in particular by companies that display their advertisements on websites, so that they can recognize the browser and thus offer targeted content.

12. What are your rights regarding Personal Data?

You may contact Regen Search to exercise one or more of the following rights regarding your Data:

  • Right of access: to access your Data processed by Regen Search and obtain a copy
  • Right to rectification: to request that Data be corrected, updated or deleted if it is inaccurate, outdated and/or incomplete
  • Right to erasure and right to be forgotten: to request the deletion of Data. This is not an absolute right, as Regen Search may be required to retain Data for legal or legitimate reasons
  • Right to restriction of processing: to request that Regen Search cease processing certain Data
  • Right to data portability: to request the transfer of Data to another controller (only for processing based on consent or contract performance)
  • Right to object or withdraw consent: to request the cessation of Data processing. This right does not apply where processing is based on contract performance
  • Right to define instructions regarding the use of your Personal Data after your death

You may also lodge a complaint with the CNIL if you consider that Regen Search has not complied with your rights or with personal data protection regulations. However, it is recommended that you contact the Company first.

You may access and consult this Privacy Policy at any time on the Website. The Privacy Policy may be modified at any time by Regen Search, in particular to take into account updates resulting from changes in data protection regulations, as well as any technical developments.

Changes to this Privacy Policy will become effective upon their publication online. You are therefore invited to regularly consult the latest version of this policy. However, you will be informed by email of any significant update to this Privacy Policy and will be invited to review the new applicable version.
